Terms and Conditions

Welcome to Mahoney ("the App"). These Terms and Conditions ("T&Cs") govern your use of the App. By downloading, installing, or using the App, you agree to these T&Cs. If you do not agree, please do not use the App.
1. About
1.1 The App:
The App is a task management tool that allows users to create, organize, and store tasks locally on their computer. The App does not require a login and stores all data in a local database on your device. However, an internet connection is required for verifying purchases with Apple's servers.
1.2 Us:
The App is owned and developed by Florian Schroeder ("we," "us," or "our"). We operate under the domain palomino.co.nz, which is not a registered company but serves as our online presence.
2. Use of the App
2.1 Permitted Use:
You may use the App for personal or professional task management purposes.
2.2 Prohibited Use:
- Reverse engineering, copying, or redistributing the App’s code or assets.
- Using the App in any way that violates applicable laws or regulations.
- Using the App to store or manage data that is unlawful or violates the rights of others.
3. User Responsibilities
3.1 Data Backup:
All tasks and associated data are stored locally on your device. You are responsible for creating backups if needed. We are not responsible for any loss of data.
3.2 Device Security:
You are responsible for maintaining the security of your device to prevent unauthorized access to your tasks.
4. Ownership and Rights
4.1 App Intellectual Property
All code, design, and functionality within the App are the intellectual property of Florian Schroeder. You may not reproduce, distribute, or create derivative works from the App without our prior written consent.
4.2 User-Generated Data
You retain full ownership of any tasks, notes, or other content ("User Data") you create within the App. We do not claim any rights over User Data, nor do we store, access, or have control over it. You are solely responsible for securing, backing up, and managing your User Data. We are not liable for any loss, corruption, unauthorized access, or security breaches affecting your User Data due to third-party actions or device-related vulnerabilities.
5. Privacy Policy
The App does not collect, store, or transmit any personal data. All data is stored locally on your device. By using the App, you acknowledge and agree that no data is shared with us or any third party.
6. Third-Party Services
The App may include third-party libraries or open-source components. You acknowledge and agree to comply with any additional terms associated with those components, which are not governed by these T&Cs.
7. Disclaimers
7.1 No Warranty:
The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the App will be available at all times, error-free, or that defects will be corrected.
7.2 Limitation of Liability:
To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of data, business interruption, or device malfunction, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages. Your sole remedy for dissatisfaction with the App is to stop using it. In jurisdictions that do not allow the exclusion or limitation of liability for incidental or consequential damages, our liability shall be limited to the maximum extent permitted by law.
7.3 Indemnification:
You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, losses, and expenses (including legal fees) arising from your use of the App, your violation of these T&Cs, or any infringement of third-party rights caused by your User Data or conduct.
7.4 Consumer Rights (New Zealand Only):
Nothing in these Terms and Conditions is intended to limit your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you are using the App for personal or household use, you may have rights under these laws, including guarantees that the App will be of acceptable quality and fit for its intended purpose. If you are using the App for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply to your use of the App, to the extent permitted by law.
8. Termination
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We may also terminate or suspend your access to the App at our sole discretion if you violate these T&Cs or for any other lawful reason. Upon termination, you must cease all use of the App.
9. Changes to These T&Cs
We may update these T&Cs from time to time. Changes will be effective upon posting. Continued use of the App after changes constitutes acceptance of the updated T&Cs.
10. Governing Law
These T&Cs are governed by the laws of New Zealand. Any disputes arising from or related to these T&Cs shall be subject to the exclusive jurisdiction of the courts of New Zealand.
